Church Asset Case Goes Before SJC
BOSTON -- The Massachusetts Supreme Judicial Court heard a case Thursday regarding St. James the Great Church in Wellesley.NewsCenter5's Steve Lacey reported that the issue centers around who owns thechurch and its assets. The case pitted the family that sold the landwhere the church stands against the Archdiocese of Boston, which istrying to shut down the church.St. James was one of the churchesslated to close in the wake of the clergy sex abuse scandal. Lawyersfor the Maffei family, who sold the 8-acre parcel, argued that the landsale more than 50 years ago was predicated on the promise that it wouldalways be home to a house of worship.
"Justice should be returned to them if the archdiocese determines thatit no longer wants to be part of this trust and no longer conduct it asa church," said Paul Hughes, an attorney for the Maffei family.Lawyers for the archdiocese disagreed, saying the terms of the land sale carry no such conditions.Outside the courtroom after the hearing, parishioners pledged to carry on the fight to keep the church open."Ifthe Maffei family had the courage to come up and enter in thislitigation, it is a big hope for us," parishioner Teresa Barlozzarisaid."I will not give up the vigil. I will fight," parishioner June Cebli said.While optimistic, lawyers for the Maffei family refused to speculate on a possible decision."It is always very precarious to guess what the judges are going to decide based upon the questions they asked," Hughes said.A decision in the case is not expected for several weeks.
